1. EQUIPMENT
The Owner agrees to hire the following plant/equipment to the Hirer:

  - Hire end (estimated): [END DATE/TIME]

2. CHARGES

3. PAYMENT
The Hirer shall pay the deposit and first invoice on signature of this
agreement. Recurring hire invoices will be issued [weekly / monthly] in
advance for the duration of the hire. Payment terms: [NET 7 / NET 14].
Late payment is subject to statutory interest under the Late Payment of
Commercial Debts (Interest) Act 1998.

4. OFF-HIRE
The Hirer must notify the Owner in writing (email acceptable) to off-hire
the equipment. Hire charges continue to accrue until the equipment is
collected or returned. An off-hire reference will be issued on
acknowledgement.

5. CONDITION AND USE
  a. The Hirer accepts the equipment in good working condition unless
     a defect is reported in writing within 4 hours of delivery.
  b. The Hirer must only allow trained, competent operators to use the
     equipment and must comply with all manufacturer instructions and
     relevant Health and Safety legislation, including PUWER 1998 and
     LOLER 1998 where applicable.
  c. The equipment must not be moved off the agreed site without prior
     written consent of the Owner.

6. INSURANCE AND RISK
Risk in the equipment passes to the Hirer on delivery and remains with
the Hirer until collection. The Hirer is responsible for insuring the
equipment for its full replacement value against loss, theft, fire,
accidental damage and third-party liability while on hire.

7. LOSS, DAMAGE AND THEFT
The Hirer is liable for the full cost of repair or replacement of
equipment lost, stolen or damaged beyond fair wear and tear, plus loss
of hire revenue while the equipment is out of service.

8. FUEL, CONSUMABLES AND CLEANING
Equipment is supplied with a full tank where applicable and must be
returned full or refuelled at the Owner's standard rate. A cleaning
charge of £[X.XX] applies to equipment returned excessively soiled.

9. TERMINATION
Either party may terminate this agreement on written notice. The Owner
may terminate immediately and recover the equipment if the Hirer
breaches any term, becomes insolvent, or fails to pay a sum when due.

10. LIMITATION OF LIABILITY
The Owner's liability under this agreement is limited to the hire
charges paid in the preceding 12 months. The Owner is not liable for
indirect, consequential or economic loss. Nothing in this clause limits
liability for death or personal injury caused by negligence, or fraud.

11. GOVERNING LAW
This agreement is governed by the laws of England and Wales and the
parties submit to the exclusive jurisdiction of the English courts.
